Definition of “Client”

For the purposes of these Terms and Conditions, the term “Client” refers explicitly to the individual who is the direct recipient of the services provided by Admissionado. The Client is the primary beneficiary and participant in the services, and will be the main point of contact for all communications related to the provision of services.

In instances where services are paid for by a third party, such as a parent or guardian, it is acknowledged and agreed that while they may facilitate the financial transaction, the term “Client” does not extend to include them unless they are also the direct recipient of the services. As the Client, the student bears the responsibility for active participation, including timely responses and adherence to the collaborative process as outlined in these Terms and Conditions.

Third parties, including but not limited to parents or guardians, by processing the payment for services, acknowledge and agree to the Terms and Conditions herein on behalf of the student for whom they are purchasing the services. Furthermore, third parties agree to inform the student of their responsibilities as a Client under these Terms and Conditions and to ensure the student understands the importance of their role in the service provision. Admissionado’s commitment to the student as the Client is to provide services aimed at benefiting the student’s educational and admission pursuits, and as such, Admissionado reserves the right to directly engage with the student in all matters concerning the services provided.

Any third party who has facilitated the payment on behalf of the Client and received the Confirmation Email acknowledges that by paying, they have or will inform the Client of all terms and conditions, and the Client is prepared to fulfill responsibilities outlined in the agreement.

Admissionado is not responsible if a third party or guardian purchases services on behalf of an individual who is willing or interested in receiving our services. We strongly recommend that prior to purchasing, third parties discuss with the intended Client to ensure their interest and commitment to engage with our services. If a third party purchases services without the explicit consent and agreement of the Client, the purchaser acknowledges that they may not be eligible for a refund as outlined in the “Refunds” section of these Terms and Conditions.

    • Engage with clients in a manner that is fair, objective, and unbiased.

    • Treat all clients equally, ensuring that each client receives the attention and service they have been promised within the scope of their purchased package
  • If Admissionado fails to meet a service obligation, we will make reasonable efforts to investigate the concern, as well as address and resolve the issue if the concern is valid.
  • If Client requests services that fall outside the scope of their purchased package, Admissionado will provide notification of any additional fees associated with these services. Clients have the option to decline such services.

Client Acknowledgements and Responsibilities

  • Client agrees that Admissionado will not write any of the Application Materials.
  • Client shall respond to all Admissionado comments with revised drafts within the agreed timeline of receiving such comments.
  • Client agrees to commence work within 60 days of receiving the Confirmation E-mail unless a timetable has been specifically customized and agreed upon (in writing, including e-mail correspondence) prior to the purchase. 60 days after a purchase has been completed, if no custom timetables have been agreed to in writing by both parties, and Client fails to respond to Admissionado’s outreach efforts (by phone, email, etc.), Admissionado’s obligations to Client shall cease.

It is the responsibility of the Client to proactively reach out and communicate with Admissionado regarding their progress or any changes in their plans (see “Deferring Packages” section below)
  • Under these terms and conditions, Admissionado Client grants Admissionado a perpetual license to use prior and final versions of Client’s Application Materials, in Admissionado’s marketing materials, which shall include Admissionado’s website. Client has the option to opt out by informing Admissionado in writing any information in the Application Materials that Client would like Admissionado to maintain as confidential in Admissionado’s marketing materials.
  • Client represents and warrants that the Client has not plagiarized or inappropriately used or obtained any materials or information, including the Application Materials, provided to Admissionado and further represents and warrants that the Client has any and all rights necessary to use and edit materials or information, including the Application Materials, provided to Admissionado. Breach of this representation and warranty may result in an automatic termination of any relationship between Admissionado and the Client.
  • Client represents and warrants that all information that has been provided to Admissionado is accurate to the best of Client’s knowledge.
  • Client represents that he or she is not a minor and has reached the age of majority in Client’s jurisdiction. In instances where the Client is a minor, the parent or guardian facilitating the payment acknowledges and agrees that the minor is providing materials to Admissionado for the purposes of receiving our services. The parent or guardian understands that they are responsible for the well-being of the minor and agree that the minor, with their support, will be actively engaging in the services provided by Admissionado.
  • To the extent such costs exist, Client agrees to incur the costs of any long distance telephone calls by calling Admissionado or its representatives for any scheduled telephone meetings. Similarly, client agrees to incur costs of wire transmittals, and any other transactional costs associated with the purchasing of Admissionado services along with full or partial refunds.

  • Client agrees to utilize their purchased mentorship package or application support package within one (1) year from the date of purchase, unless a different time frame is mutually agreed upon in writing by both Admissionado and the Client. If the Client anticipates the need for additional time beyond the one-year period, it is their responsibility to communicate this to Admissionado in advance to seek agreement on an extended timeline. This extension request must be acknowledged and approved in writing by Admissionado to be effective.
  • Clients acknowledge their responsibility for their own progress and journey in the application process. This responsibility includes promptly responding to emails, communicating effectively when falling behind schedule, and actively engaging in the process. Admissionado is not responsible for instances where clients fall behind schedule or abandon their efforts without communication. Third parties, such as parents, agree that ensuring their child, the Client, does not procrastinate is not the responsibility of the consultant. While consultants will assist with timelines and scheduling, the ultimate accountability for progress lies with the Client.
  • Client agrees that for phone consultations that arise throughout the service period, cancellations require a minimum of 24-hours notice. Failure to attend a scheduled call without giving the required notice will result in one hour being deducted from the client’s available package hours for each instance of non-compliance.
  • Third parties who facilitate payment, such as parents, are expected to refrain from attempting to communicate their own desires or objectives to the consultant in contradiction to the wishes of the Client. The focus of Admissionado’s work will be centered around the Client receiving the services.
  • Clients acknowledge that once work has commenced for a particular school application, any changes to the school selection midway through the editing process will be subject to additional fees to account for the time already invested in the initial process.

Grounds for Termination of Relationship between Admissionado and Client

Admissionado may terminate its relationship with Client for any material breach of these terms and conditions at its sole discretion, at any time, provided that a material breach has occurred.

Admissionado maintains a policy of respect and professionalism in all interactions. Should a client engage with Admissionado staff or consultants in a manner deemed disrespectful, which includes but is not limited to blackmail, use of rude language, violation of personal boundaries, or derogatory actions, Admissionado reserves the right to terminate the service relationship. In such cases, clients may be eligible for a refund for any unused services or hours, at the discretion of Admissionado.

In rare instances, Admissionado recognizes that certain clients may not fully benefit from our services or may consistently choose not to take the guidance or feedback provided by our team. If we believe that a change in consultant will not resolve the issues, Admissionado reserves the right to terminate the service relationship. Under such circumstances, a refund may be issued for unused services or hours.

Refunds

Following the Client’s initial (full or partial) transaction, Admissionado grants a “Grace Period” of twenty (20) days during which the Client may make changes to services purchased, or to the consulting arrangement. During this time, the Client may add additional schools and still take advantage of bulk package discount incentives. Client may also reduce the number of schools applied to, in which case the service fees will be reduced based upon our applicable fee schedule and the actual number of schools selected. In addition, during this twenty-day period, Client may elect to cancel service and be refunded in full, less a charge of our hourly fee multiplied by any hours used within the Grace Period. After this Grace Period has ended, no refunds whatsoever are available under any circumstances, on purchased services.

No refunds are eligible on Hourly Support.

Admissionado is not responsible or liable for any misinterpretation of the scope and content of our service packages. It is the client’s responsibility to thoroughly read and understand the descriptions and limitations of the packages offered before making a purchase. Questions should be directed to the Admissionado team and will be answered. Should a client misinterpret the nature of the services or fail to ask for clarification prior to purchase, they will not be eligible for a refund based on this misunderstanding.

Any fees outside of the purchase or refund (banking fees, wire fees, paypal fees, etc.) are borne solely by the client.

Refunds for Admissionado services associated with or purchased through an Admissionado partner/affiliate are subject to the Terms & Conditions of the partner company. Please contact the partner directly for details.

Rush Service

Admissionado shall use all reasonable efforts to return work to the Client in 24 hours or less. If Admissionado fails to return work to Client within 24 hours as promised, Client is entitled to a refund in the amount of the specific charge related to the late Rush Service package OR a rush round to use in the future.

If Client does not sign up for Rush Service and will not be able to complete a package due to time constraints, Admissionado has no responsibilities beyond the Company’s standard 72-hour turnaround, regardless of school deadlines.

There are specific periods in the year when Rush Support services may not be available due to high demand or holidays. Clients will be notified via email of these blackout periods well in advance. It is the responsibility of the clients to plan their application process and timelines accordingly, taking into consideration these notified periods where Rush Support is not available.

When requesting invoices for Rush Support, clients should assume that the standard 24-hour email response time is in effect. Clients understand that Rush Support cannot be requested on the same day and assumed to be immediately effective, nor that an invoice will be sent before 24 hours of requesting one. An invoice for Rush Support will be sent following the request, and the 24-hour rush period commences only after the invoice has been paid by the Client.

Deferring Packages

Any deferral or transfer of services must be communicated to and approved by Admissionado in writing. If Client begins his purchased service with his/her consultant, then chooses to defer services to a later date, additional charges may be incurred for any work that must be updated or re-done, at Admissionado’s current hourly rate. Clients are allowed to defer their packages for one (1) application cycle, but for no more than one (1) year from the original intended start date. If a client does not utilize their package within this timeframe, Admissionado’s obligations to the client will cease, and the client will forfeit their package. In these cases, Client is not eligible for a refund on unused or used packages.

Clients are urged to ensure that they intend to apply within the foreseeable future before purchasing a package. In cases where a client decides not to apply after purchase, Admissionado allows the client the flexibility to transfer their package to another individual or to repurpose the package value towards other available services within Admissionado’s offerings, such as career services or hourly support, provided that the new use falls within the scope of Admissionado’s services. Client agrees that recipients of transferred packages understand and accept the Terms and Conditions.

Enforcement of Terms and Conditions

These Terms and Conditions are governed and interpreted pursuant to the laws of Delaware, United States of America, notwithstanding any principles of conflicts of law.

All disputes arising out of or relating to these Terms and Conditions shall be finally resolved by arbitration conducted in the English language in Los Angeles, California U.S.A. under the commercial arbitration rules of the American Arbitration Association. The parties shall appoint as sole arbitrator a retired judge who presided in any federal district court of the United States of America. The parties shall bear equally the cost of the arbitration (except that the prevailing party shall be entitled to an award of reasonable attorneys’ fees incurred in connection with the arbitration in such an amount as may be determined by the arbitrator). All decisions of the arbitrator shall be final and binding on both parties and enforceable in any court of competent jurisdiction. Notwithstanding this, application may be made to any court for a judicial acceptance of the award or order of enforcement. Notwithstanding the foregoing, Admissionado shall be entitled to seek injunctive relief, security, or other equitable remedies from the United States District Court for the State of California or any other court of competent jurisdiction.

If any part of these terms is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of the remaining provisions. Admissionado may, at its sole discretion and without notice, revise these terms at any time by updating this posting.
